Terms of service

Who you work with

MXMPixels is run by BRYAN MAXIM DESIGN SRL (CUI 42722318, trade register no. J40/7379/2020, registered office: Șos. Mihai Bravu 147-169, bl. D5, sc. A, et. 6, ap. 26, Sector 2, București 021316, Romania). These terms apply to every project and Pixel Pass subscription you order from it. Your agreement is with the company; I, Bryan Maxim, do the work.

Projects

Each project has a written scope, a fixed price and a deadline, confirmed by email before I start. The deadline starts when your brief is complete and the invoice is paid.

Revisions

Every deliverable includes one round of revisions. Changes to the agreed scope, such as new pages or extra screens, are quoted separately before I do them.

Payment

Projects are paid upfront by invoice. Pixel Pass is billed monthly in advance and can be paused or cancelled anytime; cancellation takes effect at the end of the paid month.

Your right to cancel

If you buy as a consumer, for yourself rather than for a business, you can cancel within 14 days of our agreement, without giving a reason, by emailing me. When you send your brief or Pixel Pass request, you tick a box asking me to start within those 14 days. If you cancel after I have started, you pay for the work done until then; once the project is fully delivered, the right to cancel no longer applies (Romanian Emergency Ordinance 34/2014, art. 16). Pixel Pass can also be cancelled anytime, as explained above.

Ownership

Once a project is paid in full, you own the final designs and files I deliver. Fonts, stock photos and third-party tools remain under their own licences, which I explain when relevant. I may show finished work in my portfolio unless you ask me not to.

Websites and hosting

Websites include hosting and a .com domain for the first year. After that, hosting continues for the monthly fee agreed in your quote, unless you cancel. If you leave, I help you move your site and domain.

Liability

I take care to deliver work that is accurate and original. My total liability for any project is limited to the amount you paid for it, except where the law does not allow a limit, such as for intent or gross negligence, and without affecting your rights as a consumer. You are responsible for the content you supply, including text, photos and claims made about your business.

Complaints and disputes

If something goes wrong, write to me first and I will do my best to sort it out quickly. Consumers can also contact ANPC, Romania’s consumer protection authority, and use its alternative dispute resolution service at reclamatiisal.anpc.ro. These terms are governed by Romanian law; if you buy as a consumer, you keep the protection of the mandatory laws of the country where you live.
